IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF PIZZA LUCE TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SITE AND SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA LUCE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES YOU TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION ON AN INDIVIDUAL BASIS RATHER THAN THROUGH COURT PROCEEDINGS OR CLASS ACTIONS.

Except for disputes related to intellectual property infringement or matters eligible for small claims court, any dispute, controversy, or claim arising out of or relating to these Terms, the breach thereof, or your use of our Site or services (collectively, "Disputes") shall be finally and exclusively resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, which are available at www.adr.org.
